These Terms of Service (“Terms”) govern your access to and use of the Ghost of You mobile application, website, and related services (collectively, the “Service”) operated by Ghost of You (“we,” “us,” or “our”).By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.1. EligibilityYou must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms.2. Description of the ServiceGhost of You allows users to create and interact with an AI-generated voice clone of themselves for personal, entertainment, and communication-related purposes. Subject to the Service’s invite-only and permission-based features, users may also authorize approved friends within the app to interact with their voice clone, and may interact with the voice clones of friends who have extended such authorization to them.The Service may include voice recording, AI voice generation, conversational AI features, account management, friend invitations, access permissions, safety controls, reporting tools, blocking tools, ghost availability settings, and related functionality.Ghost of You is designed as a consent-based social voice clone app. Users may only create a voice clone of themselves, and users control who may access or interact with their own voice clone through the features available in the app.3. Self-Voice OnlyYou may only submit voice recordings and create a voice clone of your own voice.By using the Service, you represent and warrant that:the voice samples you provide are your own,
you have all rights and authority necessary to provide those recordings,
you are not impersonating another person, and
you will not use the Service to clone, simulate, imitate, or misappropriate any other person’s voice without their explicit written authorization.You may not upload, submit, or use recordings of celebrities, public figures, private individuals, or any third party unless explicitly permitted by us in writing.4. Prohibited UsesYou agree not to use the Service to:violate any law or regulation,
infringe another person’s rights,
impersonate, defraud, harass, threaten, exploit, or deceive others,
create misleading, harmful, abusive, or non-consensual voice content,
engage in stalking, abuse, defamation, intimidation, or non-consensual impersonation,
pressure, coerce, or manipulate another user into giving you access to their voice clone,
attempt to access, call, or interact with another user’s voice clone without permission,
attempt to bypass friend approvals, blocking, ghost availability settings, access controls, rate limits, or other safety features,
abuse reporting, blocking, support, or moderation tools,
attempt to reverse engineer, copy, scrape, or misuse the Service,
interfere with or disrupt the Service or its security,
use the Service for spam, fraud, illegal robocalling, or unlawful commercial activity.We may suspend, restrict, or terminate accounts that violate these Terms.5. Account ResponsibilityYou are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep your account information up to date.If you believe your account has been compromised, you must notify us immediately.6. AI LimitationsThe Service uses artificial intelligence and synthetic voice technology. You acknowledge and agree that:AI-generated responses may be inaccurate, incomplete, delayed, or inappropriate,
the voice clone may not sound identical to you at all times,
the Service may produce unexpected or incorrect outputs,
the Service is provided for general consumer use and is not guaranteed to be error-free.You should not rely on the Service for medical, legal, financial, emergency, or other high-stakes decisions.7. User ContentYou may provide recordings, text, prompts, profile data, and other content through the Service (“User Content”).You retain ownership of your User Content, subject to the rights you grant to us in these Terms.By submitting User Content, you grant us a limited, non-exclusive, worldwide, revocable license to host, store, process, reproduce, modify, and use that content solely as necessary to:operate the Service,
create and maintain your voice clone,
provide requested features,
manage friend access and ghost availability,
improve safety, moderation, support, and reliability,
investigate abuse or violations of these Terms,
comply with legal obligations,
enforce these Terms.This license ends when your content is deleted from our systems, except to the extent retention is reasonably necessary for legal, security, fraud-prevention, backup, safety, moderation, dispute-resolution, or compliance purposes.8. Voice Clone Control and DeletionYou may disable or delete your voice clone and account through the available in-app settings or by contacting support, subject to any technical, legal, safety, moderation, or compliance requirements.You may also be able to manage who has access to your voice clone, remove friends, revoke access, block users, or disable ghost availability through the features available in the app.Deletion of your account or clone may not result in immediate removal from backups, archived systems, third-party provider systems, or records that we reasonably retain for legal, security, fraud-prevention, safety, moderation, dispute-resolution, or compliance purposes. We will process deletion requests in accordance with our Privacy Policy and applicable law.9. Safety ControlsGhost of You is designed as a consent-based social voice clone app. Users control their own voice clone and may manage access through available in-app settings.Depending on the features available in the app, you may be able to:report another user for abuse, harassment, impersonation, unsafe behavior, or other violations,
block another user,
remove a friend or revoke access to your voice clone,
disable your ghost or voice clone availability,
contact support for help with safety, abuse, account, or access issues.Reporting a user does not guarantee that we will take a specific action, and we do not guarantee a particular review or response time. However, we may review reports and safety-related information when practical and may take action we believe is appropriate to protect users, enforce these Terms, or comply with law.10. PrivacyYour use of the Service is also governed by our Privacy Policy, which explains how we collect, use, retain, and share information. By using the Service, you acknowledge that you have read the Privacy Policy.11. Third-Party ServicesThe Service may rely on third-party vendors, infrastructure providers, AI model providers, voice technology providers, payment processors, analytics tools, email delivery providers, customer support tools, or other external services. We are not responsible for third-party services, websites, or products except as required by law.Your use of certain third-party features may also be subject to separate third-party terms and privacy policies.12. Paid Features and SubscriptionsCertain features of the Service may require payment, subscription, or in-app purchase. Pricing, billing terms, and feature access will be disclosed at the time of purchase.Unless otherwise stated:subscriptions automatically renew until canceled,
you may manage or cancel subscriptions through your Apple App Store account,
payments are non-refundable except as required by law or by Apple’s policies,
we may change pricing or features prospectively.If there is a conflict between these Terms and Apple’s purchase terms, Apple’s applicable purchase terms will control for billing and subscription mechanics handled through the App Store.13. Intellectual PropertyThe Service, including its design, software, branding, logos, text, graphics, interfaces, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws.Except for the limited right to use the Service under these Terms, no rights are granted to you.14. FeedbackIf you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation to you.15. Suspension, Restrictions, and TerminationWe may warn, suspend, restrict, limit, disable, or terminate your access to some or all of the Service at any time, with or without notice, if:you violate these Terms,
we believe your use creates risk, harm, abuse, safety concerns, or legal exposure,
you attempt to misuse another person’s voice clone or bypass access controls,
we receive reports or safety signals that require action,
required by law,
the Service is changed, discontinued, or no longer supported.Depending on the situation, we may take intermediate enforcement actions before or instead of terminating an account, including limiting account functionality, restricting friend or ghost access, disabling a voice clone, disabling ghost availability, removing access between users, or preserving records needed for safety, security, legal, moderation, dispute-resolution, or compliance purposes.You may stop using the Service at any time.Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution.16. DisclaimersTHE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.We do not guarantee that the Service will be uninterrupted, secure, accurate, or free from bugs, errors, harmful components, misuse, abuse, or unauthorized access.17. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOST OF YOU AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR
$100 USD.Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.18. IndemnificationYou agree to defend, indemnify, and hold harmless Ghost of You and its affiliates, officers, employees, contractors, and licensors from and against any claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:your use of the Service,
your User Content,
your violation of these Terms,
your violation of any law or another person’s rights.19. Governing LawThese Terms are governed by the laws of the State of California, without regard to conflict of law principles, except to the extent otherwise required by applicable law.20. Dispute ResolutionAny dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise. You consent to the personal jurisdiction of those courts.21. Changes to These TermsWe may update these Terms from time to time. If we make material changes, we may provide notice through the app, website, or other reasonable means.
