These Terms of Service (“Terms”) govern your access to and use of the Ghost of You mobile application, website, and related services (collectively, the “Service”) operated by Ghost of You (“we,” “us,” or “our”).By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.1. EligibilityYou must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms.2. Description of the ServiceGhost of You allows users to create and interact with an AI-generated voice clone of themselves for personal, entertainment, and communication-related purposes. Subject to the Service’s invite-only and permission-based features, users may also authorize approved friends within the app to interact with their voice clone, and may interact with the voice clones of friends who have extended such authorization to them. The Service may include voice recording, AI voice generation, conversational AI features, account management, friend invitations, access permissions, and related functionality.3. Self-Voice OnlyYou may only submit voice recordings and create a voice clone of your own voice.By using the Service, you represent and warrant that:the voice samples you provide are your own,
you have all rights and authority necessary to provide those recordings,
you are not impersonating another person, and
you will not use the Service to clone, simulate, imitate, or misappropriate any other person’s voice without their explicit written authorization.You may not upload, submit, or use recordings of celebrities, public figures, private individuals, or any third party unless explicitly permitted by us in writing.4. Prohibited UsesYou agree not to use the Service to:violate any law or regulation,
infringe another person’s rights,
impersonate, defraud, harass, threaten, exploit, or deceive others,
create misleading or harmful voice content,
engage in stalking, abuse, defamation, or non-consensual impersonation,
attempt to reverse engineer, copy, scrape, or misuse the Service,
interfere with or disrupt the Service or its security,
use the Service for spam, fraud, illegal robocalling, or unlawful commercial activity.We may suspend or terminate accounts that violate these Terms.5. Account ResponsibilityYou are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep your account information up to date.If you believe your account has been compromised, you must notify us immediately.6. AI LimitationsThe Service uses artificial intelligence and synthetic voice technology. You acknowledge and agree that:AI-generated responses may be inaccurate, incomplete, delayed, or inappropriate,
the voice clone may not sound identical to you at all times,
the Service may produce unexpected or incorrect outputs,
the Service is provided for general consumer use and is not guaranteed to be error-free.You should not rely on the Service for medical, legal, financial, emergency, or other high-stakes decisions.7. User ContentYou may provide recordings, text, prompts, profile data, and other content through the Service (“User Content”).You retain ownership of your User Content, subject to the rights you grant to us in these Terms.By submitting User Content, you grant us a limited, non-exclusive, worldwide, revocable license to host, store, process, reproduce, modify, and use that content solely as necessary to:operate the Service,
create and maintain your voice clone,
provide requested features,
improve safety, moderation, support, and reliability,
comply with legal obligations,
enforce these Terms.This license ends when your content is deleted from our systems, except to the extent retention is reasonably necessary for legal, security, fraud-prevention, backup, or compliance purposes.8. Voice Clone Control and DeletionYou may disable or delete your voice clone and account through the available in-app settings or by contacting support, subject to any technical, legal, or compliance requirements.Deletion of your account or clone may not result in immediate removal from backups or archived systems, but we will process deletion requests in accordance with our Privacy Policy and applicable law.9. PrivacyYour use of the Service is also governed by our Privacy Policy, which explains how we collect, use, retain, and share information. By using the Service, you acknowledge that you have read the Privacy Policy.10. Third-Party ServicesThe Service may rely on third-party vendors, infrastructure providers, AI model providers, payment processors, analytics tools, or other external services. We are not responsible for third-party services, websites, or products except as required by law.Your use of certain third-party features may also be subject to separate third-party terms and privacy policies.11. Paid Features and SubscriptionsCertain features of the Service may require payment, subscription, or in-app purchase. Pricing, billing terms, and feature access will be disclosed at the time of purchase.Unless otherwise stated:subscriptions automatically renew until canceled,
you may manage or cancel subscriptions through your Apple App Store account,
payments are non-refundable except as required by law or by Apple’s policies,
we may change pricing or features prospectively.If there is a conflict between these Terms and Apple’s purchase terms, Apple’s applicable purchase terms will control for billing and subscription mechanics handled through the App Store.12. Intellectual PropertyThe Service, including its design, software, branding, logos, text, graphics, interfaces, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws.Except for the limited right to use the Service under these Terms, no rights are granted to you.13. FeedbackIf you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation to you.14. Suspension and TerminationWe may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if:you violate these Terms,
we believe your use creates risk, harm, or legal exposure,
required by law,
the Service is changed, discontinued, or no longer supported.You may stop using the Service at any time.Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution.15. DisclaimersTHE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.We do not guarantee that the Service will be uninterrupted, secure, accurate, or free from bugs, errors, or harmful components.16. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOST OF YOU AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR
$100 USD.Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.17. IndemnificationYou agree to defend, indemnify, and hold harmless Ghost of You and its affiliates, officers, employees, contractors, and licensors from and against any claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:your use of the Service,
your User Content,
your violation of these Terms,
your violation of any law or another person’s rights.
18. Governing LawThese Terms are governed by the laws of the State of California, without regard to conflict of law principles, except to the extent otherwise required by applicable law.19. Dispute ResolutionAny dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise. You consent to the personal jurisdiction of those courts.If you want, you can later add arbitration language, but for now keeping this section simple is usually easier to understand.20. Changes to These TermsWe may update these Terms from time to time. If we make material changes, we may provide notice through the app, website, or other reasonable means.
